LIVE DATA SOLUTIONS commits to take the necessary measures to ensure the security and confidentiality of the personal data entrusted to it. LIVE DATA SOLUTIONS only processes personal data on the instructions and on behalf of its partners and customers.

The origin of the data processed

LIVE DATA SOLUTIONS does not collect data from natural persons. It is its Partners, file owners who collect data from people and who then transmit their database to LIVE DATA SOLUTIONS as a subcontractor for the creation of a database intended for marketing.

As part of its partnerships LIVE DATA SOLUTIONS only contracts with companies that undertake to comply with the legislation in force in the processing of personal data.

The personal data that LIVE DATA SOLUTIONS processes comes from file owners from the following fields of activity :

  • E-merchants
  • Satisfaction surveys
  • Contests / Co-registration / Vertical sites

Use of processed data

LIVE DATA SOLUTIONS sells data from its Partners' databases to its customers.

LIVE DATA SOLUTIONS helps its clients to build and optimize their marketing, loyalty, customer relationship, communication, studies and surveys campaigns through statistical processing and analysis in order to :

  • Select prospects for a marketing and/or communication campaign
  • Allow our customers to enrich their customer base with contact data
  • Allow our client to better know and therefore retain their own customers
  • Enable relevant surveys and studies to be carried out

Different channels can be used to contact people: by post, by telephone, by email, by sms.

Operations allowing the personalization of the communication can be carried out in order to contact you only within the framework of your centers of interest.

To carry out this processing, LIVE DATA SOLUTIONS acts exclusively at the request of its customers and on their behalf.

LIVE DATA SOLUTIONS never comes into contact with people on its own behalf.

Once the selection operation has been carried out by LIVE DATA SOLUTIONS, the data is either processed by LIVE DATA SOLUTIONS on behalf of its customers, or transferred to service providers designated by the Customer, or transmitted to the customer.

Behavioral data collection for Instant Mail®

As part of the proprietary technological solution, INSTANT MAIL®, LIVE DATA SOLUTIONS itself collects behavioral data which makes it possible to define the best time to send a campaign. LIVE DATA SOLUTIONS collects this information via a network of partners who have placed a tracking pixel in their email campaigns sent to partner optin bases. The contractual relationship between LIVE DATA SOLUTIONS and the partners requires strict compliance with law n ° 78-17 of January 6, 1978 as amended, relating to data processing, files and freedoms, as well as Regulation 679/2016 of April 27 2016 relating to the protection of personal data.

LIVE DATA SOLUTIONS sells this information to customers with an optin base in order to complete the latter with common contacts.

LIVE DATA SOLUTIONS cannot under any circumstances deliver the information if the contact does not already exist in the customer's database. The message is sent by the customer whose contact is opt-in in accordance with the legislation, from the moment the matching of an opt-in is done.

Exercise of rights

In accordance with the legislation in force and more specifically Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on free movement of this data (hereinafter the "GDPR"), applicable from May 25, 2018, you have a right of access, rectification, deletion, directives (portability or instructions after your death) on your data and opposition for legitimate reasons.

You can withdraw the consent granted at any time and request the deletion of your data.

As part of these requests LIVE DATA SOLUTIONS will delete the data in the databases processed by its teams and will systematically send this request to the Partner who provided it with this data for marketing.

The rights can also be exercised directly with the Partner who collected the personal data or with the customer who contacts the person. A response must be provided within 1 month.

In any communication that reaches you after processing your personal data, you are informed of your rights with the possibility either to unsubscribe in the event of email and sms, or to contact the campaign manager in order to oppose the use of your data.

Data storage duration

In accordance with article 5e of regulation 2016/679 of April 27, 2016, personal data is only kept in a form allowing identification for a period that does not exceed the period necessary for the purposes for which they are collected. and processed.

As such, the data is kept by LIVE DATA SOLUTIONS for the duration indicated by its Partners.

In the absence of instructions received from the latter, LIVE DATA SOLUTIONS has established strict rules respecting the rights and freedoms of individuals and consequently, any individual whose last transaction with a partner dates back more than 3 years will not be kept by LIVE DATA SOLUTIONS.

In the case of processing involving the provision to LIVE DATA SOLUTIONS of its Customers' data, the data is destroyed according to the customer's instructions.

Data protection

To do this, LIVE DATA SOLUTIONS has defined a strict personal data security and confidentiality policy.

LIVE DATA SOLUTIONS personnel with access to data are regularly made aware of the security of personal data and more generally of computer security. Thus the authentication of users, the management of authorizations and the securing of workstations follow strict rules.

An IT charter signed by all staff covers all of these points.

The protection of the information system is our priority. The data is stored on our servers at OVH, 2 Rue Kellermann, 59100 Roubaix, France.

Our infrastructure is managed by our administrators who master all the security conditions ensuring total control of the data entrusted to us. Regular maintenance operations are carried out and we have a backup system.

The physical security of the premises is ensured by remote monitoring devices and the data is kept in a secure environment with restricted access.

All our data transfers are done via secure protocols such as HTTPS, SFTP or CFT. These protocols guarantee data encryption and for CFT, additional compression.

In the event of a data breach, a procedure has been put in place to notify our Partners as quickly as possible and to document the elements necessary for informing the supervisory authority if necessary.
